By accessing or using Surely ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service is operated by Spark Collective BV, a company registered in Belgium ("we", "us", or "our").

2. Description of Service

Surely is an AI-powered insurance analysis tool that helps you understand your insurance policies. The Service includes:

  • Upload and storage of insurance policy documents
  • AI-powered analysis to extract policy information
  • Identification of potential coverage gaps
  • Suggestions for potential savings opportunities
  • WhatsApp communication for policy questions (optional)

3. Surely as your research tool, not your advisor

Surely is your research assistant, not your broker. We help you understand your policies, identify gaps, and prepare for conversations with your insurance advisor. The goal is to give you the information to evaluate advice — not to replace the professionals who give it.

Think of it like having a financial analyst review your policies before your broker meeting. Surely surfaces what to ask, what to watch out for, and what you might be missing. Your broker, financial advisor, or legal professional then acts on that information.

To be transparent about what this means in practice:

  • Surely is not a licensed insurance broker or agent
  • Our analysis is informational — it is not financial or legal advice
  • AI analysis may contain errors or misinterpretations; always verify with your provider
  • Consult qualified professionals before making insurance decisions

Any decisions you make based on information from Surely are your own responsibility.

4. User Responsibilities

When using the Service, you agree to:

  • Provide accurate and truthful information
  • Upload only documents that you have the right to share
  • Keep your account credentials secure
  • Not use the Service for any illegal or unauthorized purpose
  • Not attempt to circumvent security measures
  • Verify all AI-generated analysis with your insurance provider

5. Accuracy of Uploaded Documents

The quality of our analysis depends on the documents you provide. You are responsible for:

  • Ensuring uploaded documents are legible and complete
  • Uploading current, valid policy documents
  • Notifying us if you believe an analysis is incorrect

We cannot guarantee accuracy of analysis if documents are incomplete, outdated, or of poor quality.

6. Limitation of Liability

To the maximum extent permitted by Belgian law:

  • The Service is provided "as is" without warranties of any kind
  • We do not warrant that the Service will be error-free or uninterrupted
  • We are not liable for any decisions made based on our analysis
  • We are not liable for any direct, indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for the Service in the past 12 months

This limitation of liability applies to the fullest extent permitted by applicable law.

7. Intellectual Property

The Service, including its design, code, and content (excluding your uploaded documents), is owned by Spark Collective BV and protected by intellectual property laws.

You retain ownership of any documents you upload. By uploading documents, you grant us a limited license to process them for the purpose of providing the Service.

8. Account Termination

You may delete your account at any time. We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • We are required to do so by law
  • We discontinue the Service

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with GDPR.

10. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law and Jurisdiction

These Terms are governed by Belgian law.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Belgium.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
